Welcome to referencerealestate.mx (the “Site”). Access to, browsing of and use of the Site are governed by these Terms and Conditions of Use (the “Terms”).
The Site is operated by SERVICIOS NUNVAZ, commercially operating under the brand “Reference Real Estate” (hereinafter, “Reference Real Estate”, “we”, “us” or the “Controller”), with address at AV. BAJA CALIFORNIA 274, PISO 2-B, COL. HIPODROMO, CUAUHTEMOC, CIUDAD DE MEXICO, C.P. 06100, and contact email info@referencerealestate.mx.
By accessing, browsing, using the Site or submitting information through its forms, you agree to these Terms. If you do not agree, you must refrain from using the Site.
Section 01
Purpose of the Site
The Site is intended for informational, commercial and lead-generation purposes regarding real estate services, property listings, investment opportunities, market-related content, prospect attention and communication with users interested in properties or related services.
The Site may display properties for purchase, sale, lease or investment, as well as tools, content, images, forms, calculators, maps, property sheets, blog publications and other real-estate-related materials.
Section 02
Informational Nature; No Binding Offer
The information contained on the Site is for informational, commercial and reference purposes only.
The publication of properties, prices, estimated returns, locations, dimensions, amenities, images, simulations, calculators, promotions or any other content does not by itself constitute:
- a) a binding offer
- b) a promise to sell or lease
- c) a guarantee of availability
- d) a guarantee of final price
- e) legal, tax, accounting, financial or investment advice
- f) an obligation to close or accept a transaction by Reference Real Estate, the owner, the developer or any related third party
Any real estate transaction will be subject to document review, actual availability, specific conditions, negotiation between the parties and, where applicable, execution of the corresponding legal instruments.
Section 03
Property Information
Reference Real Estate makes reasonable efforts to keep the information on the Site updated; however, you acknowledge and agree that:
- a) prices may change without prior notice
- b) property availability may vary at any time
- c) certain properties may be withdrawn, reserved, sold or leased without prior notice
- d) images, renders, plans, maps, tours, descriptions, dimensions, finishes, equipment, views, amenities and other visual or descriptive elements may be illustrative or for reference only
- e) information regarding location, square footage, layout, maintenance, taxes, ownership regime, documentation, liens, restrictions, legal status or transaction conditions must be verified case by case
- f) amounts related to closing, deeds, appraisals, notary fees, taxes, commissions, maintenance fees or other transaction costs may not be included in displayed prices
- g) any projected yield, return, appreciation, investment estimate or financial calculation shown on the Site is indicative only and is not guaranteed
The user is responsible for verifying with our advisors the information applicable to each property before making any decision.
Section 04
Contact, Forms and Lead Generation
The Site may allow users to submit information requests, messages, contact details or statements of interest through forms, email, WhatsApp, phone calls, social media or other means.
Submitting forms or contact requests:
- a) does not by itself create a contractual relationship
- b) does not constitute automatic acceptance as a client
- c) does not create exclusive representation, exclusive brokerage, agency, accrued commission or an obligation to close
- d) does not require Reference Real Estate to accept, process or follow up on any request where there is operational impossibility, incomplete information, false data or justified cause
The user agrees to provide truthful, current and sufficient information.
Section 05
Tools, Calculators and Projections
Calculators, simulators, projections or tools available on the Site are for informational and illustrative purposes only.
Their results do not constitute financial, tax, accounting, legal or investment advice, nor do they replace the corresponding independent professional assessment in each case.
Section 06
Third-Party Platforms and Services
Reference Real Estate may rely on technology platforms, listing tools, analytics, messaging, advertising and property or prospect management services, including EasyBroker and other third-party services.
The use of such platforms does not mean that those third parties provide an independent guarantee regarding the accuracy, availability, suitability, legality or viability of any property or transaction.
Likewise, the Site may contain links, integrations, buttons, widgets or access to third-party services. The use of such services is governed by the terms, conditions and privacy notices of each third party, and therefore Reference Real Estate assumes no responsibility for their content, operation, availability or data processing outside its own sphere of control.
Section 07
User Obligations
The user agrees to use the Site lawfully, responsibly and in accordance with these Terms.
Among other things, the following are prohibited:
- a) using the Site for unlawful, fraudulent or misleading purposes
- b) providing false or inaccurate information, or information belonging to third parties without authorization
- c) attempting to access restricted areas, servers, databases or unauthorized functionalities
- d) interfering with the operation or security of the Site
- e) introducing viruses, malware, bots, harmful scripts or automated extraction mechanisms
- f) scraping, crawling, harvesting, mass republication or automated extraction of listings, content or data without prior written authorization
- g) copying, distributing, modifying, reproducing, exploiting or commercializing Site content without authorization
- h) using Site content for unfair competition or unauthorized commercial republication
Section 08
Intellectual Property
All intellectual and industrial property rights over the Site and its content, including without limitation texts, designs, logos, trademarks, photographs, renders, data sheets, compilations, code, structure, selection and arrangement of content, belong to Reference Real Estate, SERVICIOS NUNVAZ or their respective owners/licensors.
Nothing contained on the Site shall be construed as a transfer, license or authorization of use not expressly granted.
Section 09
Limitation of Liability
To the fullest extent permitted by applicable law, Reference Real Estate shall not be liable for direct, indirect, incidental, special, consequential damages or loss of opportunities arising from:
- a) access to, use of or inability to use the Site
- b) errors or omissions in published information
- c) changes in price, availability or property conditions
- d) decisions made by the user based on information from the Site
- e) technical failures, interruptions, viruses, attacks, downtime or unauthorized access
- f) acts or omissions of third parties, owners, developers, technology platforms, service providers or authorities
Nothing in these Terms excludes liability that cannot be lawfully limited under applicable law.
Section 10
Privacy and Personal Data
The processing of personal data collected through the Site is governed by the applicable Privacy Notice, available at: https://www.referencerealestate.mx/en/privacy
Use of the Site, as well as submission of forms or contact requests, implies that the user acknowledges having read such notice.
Section 11
Modifications to the Site and the Terms
Reference Real Estate may modify, update, suspend, limit or discontinue at any time and without prior notice:
- a) the content of the Site
- b) the properties listed
- c) the functionalities or tools available
- d) these Terms
Such modifications will become effective upon publication in this same section. Continued use of the Site after publication constitutes acceptance of the changes.
Section 12
Governing Law and Jurisdiction
These Terms are governed by the applicable laws of the United Mexican States.
For the interpretation, compliance and resolution of disputes arising exclusively from the use of the Site, the parties submit to the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles, except for any non-waivable consumer protection provision that may apply.
